In the application for security of costs the affidavit of Michael Stern (Head of Legal and Business Affairs) of Flextech states“ I respectfully ask this Honorable Court to agree that the company search reveals that the Defendant (UKNS) is a company of limited means, and that it is likely to be unable to pay the costs due in the event that its Counterclaim is unsuccessful. In particular, the Defendant’s profit on its ordinary activities for the period October 1995 to October 1996 (on turnover of no more than £13,667) was as little as £1,415.” 

My Solicitor, Neil Aspess also acted as company secretary of (UKNS) and knew that I had paid the sum of £629,063.70 to Flextech between April 1997 and March 1998. as confirmed in the company accounts, which he signed off as secretary in November 1998. using this knowledge with the aid of my barrister Joe Smouha he withholds from the Courts the financial positions of (UKNS) & (ENS) for the year 1997 to 1998 which was £975,772.53, Allowing Flextech and their solicitors Wiggin & Co to stay (remove) most of my Counterclaim by obtaining an Order for Security for Costs against UKNS, Before continuing on to totally remove my defence.
